İçtihat Uyuşmazlığı Nedeniyle Adil Yargılanma Hakkının İhlali

چکیده
İçtihat uyuşmazlığının AİHS m. 6/1 kapsamında yer alan adil yargılanma hakkının ihlaline yol açtığı, AİHM içtihadıyla teyid edilmiş bulunmaktadır. Ülkemiz yargılama sisteminden kaynaklı içtihat farklılığının önemli boyutlara ulaşmış olması, bu yargı organı tarafından aleyhimize verilen çok sayıdaki kararla da kanıtlanmış Aynı olgu, bireysel başvuru verilmiş Anayasa Mahkemesi kararlarında ön plana çıkmaktadır. 
 Özellikle iş hukuku ve sosyal güvenlik alanındaki uyuşmazlıkları, işçilerin alın terlerinin karşılığı olan haklarını elde etmelerini güçleştiren ciddi bir soruna dönüşmüş İçtihadı birleştirme sistemimizin karmaşık yapısı belirtilen sorunları daha ağırlaştırmaktadır. Bu incelemeyle, içtihadı sisteminin hakkı açısından ortaya çıkardığı sorunlar ile sistemin aksayan yönlerinin belirlenerek de lege ferenda açsından yeni model önerisinin konulması amaçlanmıştır.
